The user agrees to (a) provide true, accurate, current and complete information about the user’s company, the user’s products and the user’s services, as specified in the online registration form, website and emails addressed to IT4BILLING. and (b) promptly update and maintain the accuracy of such information as necessary.
If any information provided by the user is false, inaccurate, not current or incomplete, IT4BILLING has the right, without prior notice, to suspend or terminate the user’s account without incurring any liability to the user as a result of such action.
You agree not to use the service for illegal purposes or to transmit material that is illegal or objectionable, or that infringes or may violate intellectual property or other rights that you do not own.
Any changes to the TC and notices to you will be confirmed by e-mail or a Service startup screen describing the changes to the TC or notice. User agrees to be bound by changes or notice.
IT4BILLING will provide the registered user (via a Username and a password) with access to its online backoffice (as and when the Service is available), which operates via the World Wide Web at WWW.IT4BILLING.COM.
The user agrees to provide the IT4BILLING.COM online address with all relevant details of his business as requested by the Service.
IT4BILLING will provide the user with an address or URL addresses, online or not, to allow the user to have access to the service of issuing documents and financial management.
You must (a) provide yourself with access to the World Wide Web and pay any service fees due in connection with access, (b) provide all equipment necessary for you to make such a connection to the World Wide Web, including a computer or any other system
IT4BILLING will protect user information and will not release it to third parties outside IT4BILLING, except as required (a) explicitly by the Service or (b) by Law to comply with any court order or (c) by competent public regulatory bodies or (d) if necessary to enforce the Terms and Conditions or (e) to respond to claims of infringement of third party rights, or (e) to protect IT4BILLING’s rights, reputation or property.
The Service may provide links to other websites or web resources. The User acknowledges and agrees that IT4BILLING. (a) is not responsible for the privacy policies of such external sites or resources and (b) does not endorse and is not responsible for any content, advertising, products or other materials on or available on such sites or resources.
The User acknowledges and accepts that IT4BILLING will have the full right to access the User’s account and data to investigate technical issues or to carry out routine maintenance.
The user has the right and the possibility at any time to verify and modify his personal data. For this, IT4BILLING will indicate how to do it.
The user agrees to be solely and entirely responsible for the content of the user data entered and transmitted through the service.
The User acknowledges and agrees that IT4BILLING does not endorse and is not responsible for the content of any User data entered on the Service and is not responsible for any unlawful or objectionable content, or content that infringes or may infringe intellectual property or any other rights.
The User agrees that IT4BILLING will not be responsible for the deletion or failure to store user data. The user is advised to store and maintain backup copies of all data that the user wishes to keep.
The user will receive a username and a personal password upon successful completion of the registration process. The user is solely responsible for maintaining the confidentiality of the personal password and is fully responsible for all activities on the user’s account. The user agrees to immediately notify IT4BILLING of any unauthorized use of the user’s password or any other breach of security.
User agrees to comply with all applicable local, state, national and international laws and regulations relating to User’s use of the Service.
You agree (a) not to use the Service for illegal purposes and (b) not to interfere with or disrupt the Service or servers or networks connected to the Service and (c) to comply with all connection network requirements, procedures, policies and regulations. to the Service.
User agrees not to gain or attempt to gain unauthorized access to other computer systems or networks connected to the Service.
IT4BILLING reserves the right to modify, suspend or discontinue, temporarily or permanently, the Service. The user agrees that IT4BILLING will not be liable to the user or third parties for any modification, suspension or discontinuance of the Service.
You acknowledge and agree that the content, including but not limited to text, software, software programs, graphics or other materials presented to you through the Service, is protected by copyrights, trademarks, service marks, patents or other property rights.
The user acknowledges and agrees that the user is allowed to use this Service only as expressly authorized by IT4BILLING, and may not copy, reproduce, transmit, distribute or create services derived from such content without the express authority of its owner.
The user agrees not to resell, rent or contract the Service to third parties.
The user expressly agrees that the use of the Service is at the user’s sole responsibility. The service is provided “as is” and “as available. IT4BILLING will make every effort to ensure that the Service is accurate and uninterrupted.
The user understands and agrees that all data downloaded or uploaded to the Service is done at the user’s own discretion and risk, and that the user will be solely responsible for any damage to the user’s computer system or loss of data resulting from the download or upload such data.
No advice or information, whether oral or written, obtained by the IT4BILLING user or through the Service, will create any warranty not expressly stated in this document.
The user agrees that IT4BILLING will not be liable for any direct or indirect, incidental, special or consequential damages, for damages for lost profits, data or other intangible losses resulting from: (a) the use or inability to use the Service or ( b) the cost of purchasing substitute goods and services or (c) transactions carried out through or from the Service or resulting from unauthorized access or alteration of user data or transmissions.
The user further agrees that IT4BILLING will not be liable for any damages arising from interruption, suspension or termination of the Service, regardless of whether such interruption, suspension or termination was justified, negligent or intentional, inadvertent or advertising.
The user agrees that IT4BILLING may terminate the user’s account at any time if the terms and conditions of the service have been violated, if he voluntarily terminates the service or does not use it for an extended period of time (more than 6 months)
The user acknowledges and agrees that IT4BILLING can immediately delete all user information if the user terminates the service or does not use it for more than 6 months.
IT4Billing will not be liable to the user for any loss or damage suffered by the user resulting from the termination of the Service.
The user may terminate the use of the service at any time, in its sole discretion. The termination of the user does not constitute a waiver of the obligations contracted by the user regarding these Terms and Conditions.
The Laws of Portugal will govern the Terms and Conditions and the relationship between the User and IT4BILLING. The User agrees to irrevocably submit to the exclusive jurisdiction of the Portuguese courts.
IT4BILLING’s failure to exercise or enforce any right or provision of the Terms and Conditions will not constitute a waiver of such right or provision.
You agree that, regardless of any statute or law, any claim or action that is recurring or related to the Terms and Conditions or use of the Service must be brought six (6) months after such claim or action has arisen, or will be void.
